In case you didn’t know – FADA or H.R.2802 is the a bill that
Prohibits the federal government from taking discriminatory action against a person on the basis that such person believes or acts in accordance with a religious belief or moral conviction that: (1) marriage is or should be recognized as the union of one man and one woman, or (2) sexual relations are properly reserved to such a marriage.
In other words, it is meant to allow people and businesses to discriminate against LGBTQ. And if you read it broadly, and you know some people will – it also means anyone who has sex outside of marriage.
“sexual relations are properly reserved to such a marriage.” – that’s nearly everyone but the Amish and a couple of Evangelicals.
I may be reading it broadly and I don’t think they meant it mean that because in their worldview gay sex is worse than extramarital sex for reasons. But there it is.
However, FADA does not give cover to a government employee – like a county clerk. So those people need to do their job, regardless. It doesn’t prevent any proper entitlement or benefit from the government or apply to any private company with a government contract.
HOWEVER – it would allow any Private Company who has or is applying for a government contract to discriminate in hiring or practice. So…
But it does let Mom & Pop Deli kick out LGBTQ folk. It allows a company to discriminate against LGBTQ. It keeps doors closed in hiring circumstances. It recalls all too vividly the Jim Crow Laws. Only, in some sense worse, because no equal access (however horribly implemented) must be maintained. This is just a shutout option.
Again, let’s take a step back and look again at the second clause. Because perhaps you felt fine just shaking your head sadly at the sad plight of gay people.
or (2) sexual relations are properly reserved to such a marriage.
Does that apply to you? Has it ever applied to you? Do you want the company you work for to be able to discriminate against you because you have sex outside of marriage? Hmmmm?
The bill has been hanging around for awhile. But it’s facing a Conservative Congress and the Orange Yam. It’s an easy win for them unless we fight. Don’t let them win.
Whatever happened to separation of Church and State?
Lbr, they were only ever luke warm about that.
